Political persecution of civil activist Yerkyn #SABANSHIYEV.

Yerkyn made a statement saying that he did not accept the illegal court sentence on the basis of which he was found an extremist. The materials in a politically motivated criminal case under Article 405 Part 2 were trumped up and fabricated.

We would like to remind you that Yerkyn SABANSHIYEV is a participant of peaceful protests, pickets, a former political prisoner, was arbitrarily kept in the pre-trial detention facility for 3 months for the duration of pre-trial investigation. He participated in the humanitarian aid campaign for the families of political prisoners.

On 7 April 2021 SABANSHIYEV Yerkyn, was illegally sentenced to 1 year of restriction of liberty in a politically motivated criminal case under Article 405 Part 2 of the Criminal Code («participation in an extremist organisation»).

Judge #KELEMSEITOV Yerkebulan also imposed 100 hours of community service, ordered Yerkyn SABANSHIYEV to pay procedural costs in the amount of 840 and 50 tenge and the amount of 27,780 tenge to the «Crime Victims’ Compensation Fund».

The judge illegally prohibited Yerkyn from engaging in social activities and using social networks for 3 years.

Such actions indicate that Kazakhstani authorities misinform international partners about the «Tokayev’s listening state», directly violate international obligations, politically persecuting activists, in particular:

— The International Covenant on Civil and Political Rights;
— the recommendations of the European Parliament Resolution of 11 February 2021;
— OSCE recommendations on freedom of peaceful assembly after elections in the report;
— the recommendations of the UN Special Rapporteurs on Freedom of Peaceful Assembly and Association;
— the recommendations of the UN Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism (abuse of extremism charges for political persecution).
